The ex-lawyer for the former president has stepped down as the US Attorney for New Jersey. This decision was prompted by a judicial decision that invalidated her eligibility to hold the office.

Attorney General's Statement

US Attorney General, the Attorney General, accepted her stepping down on Monday. Bondi stated that the appeals court finding made it "untenable" for Habba to effectively run her office.

"But do not mistake adherence to the ruling as defeat," she wrote. "This battle will now reach across America."

Habba's exit comes a week after a US appeals court found that she had been unlawfully serving as US attorney. This judgment is likely to affect scores of prosecutions in New Jersey.

The court ruled that a temporary posting that bypassed Senate approval ran afoul of the federal law governing appointments.

Bondi said that the former prosecutor will continue working within the justice department as a high-level advisor. Habba plans to seek further review of the court's action, in the hope of achieving a different outcome.

On a social media platform, she contended that the judiciary "cannot be permitted to override the appointment of lawyers entrusted with performing the executive branch's core responsibility of criminal prosecution."

Habba, was initially recruited to Donald Trump's lawyers in 2021. Subsequently, she acted for the former president in his business records case in 2024, which resulted in his conviction on 34 counts of falsifying business records.

Before her appointment to the top New Jersey post, Trump had revealed he was selecting her as his senior adviser during his second administration, calling Habba as deeply loyal and a "tireless advocate for justice".
